Terms of Service

1. Agreement

By creating an account or using MapLayer ("Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Service description

MapLayer provides a cloud-based map visualization platform for corporate field teams, including features for data layer management, visit tracking, route optimization, and team collaboration.

3. Account and organization

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your password
  • One organization account per company. Adding users from outside your organization is not permitted without a written agreement
  • You may not share your account credentials with others

4. Subscription and billing

  • Subscriptions are billed monthly or annually in advance
  • The 14-day trial period is free with no credit card required
  • After trial, a valid payment method is required to continue
  • You can cancel at any time; cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial months, except where required by law
  • We may change prices with 30 days notice. Continued use after the notice period constitutes acceptance

5. Acceptable use

You may not use MapLayer to:

  • Violate any applicable law or regulation
  • Upload data that infringes third-party intellectual property rights
  • Attempt to reverse-engineer or compromise the security of the Service
  • Resell or sublicense the Service without written permission
  • Upload personal data of third parties without their consent

6. Your data

You retain full ownership of all data you upload or create in MapLayer (store locations, statuses, comments). We do not claim any rights to your data. See our Privacy Policy for details on how we handle it.

We process your data as a data processor acting on your instructions, in accordance with GDPR Article 28.

7. Service availability

We aim for 99.9% uptime on Business plans. For other plans, we provide the Service on a best-effort basis. We may perform maintenance that causes brief unavailability; we will announce scheduled downtime in advance when possible.

8. Limitation of liability

To the maximum extent permitted by law, MapLayer is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 3 months prior to the claim.

9. Termination

We may suspend or terminate your account for material breach of these Terms, with or without prior notice. Upon termination, your data will be deleted within 90 days per our data retention policy.

10. Governing law

These Terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Munich, Germany.

11. Changes

We may update these Terms. Material changes will be communicated by email at least 14 days in advance. Continued use constitutes acceptance.
